The Tennessee Legislature voted to adopt HB580/SB0623 “Prohibited Concepts” Law (more well-known as the “Anti-CRT Law” on May 25, 2021. It was signed into law by Governor Bill Lee on May 25, 2021, and became Tennessee Code Annotated (TCA) § 49-6-1019, which went into effect on July 1, 2021. View it here:
The TN Department of Education under Penny Schwinn promulgated emergency rule 0520-12-04, that became effective on November 8, 2021. The rule includes the requirements for each LEA and the process for filing a complaint alleging an LEA has violated TCA § 49-6-1019.

MFL-WC assesses the enforcement of this law to be intentionally hostile to parents and grandparents and dissuades Tennesseans from exercising this law for the following reasons:
- Complainant must be a parent of a currently enrolled student or a current LEA employee. Grandparents and citizens not allowed.
- Must be reported within 30 days of concept being taught. Of course, most parents are kept in the dark about these teachings, so it is likely to take more than 30 days for a parent to realize that it occurred.
By all appearances, the Tennessee Department of Education under Commissioner Penny Schwinn and Governor Bill Lee have managed to completely dodge enforcement of this law. The law itself is largely without teeth and our executive branch of state government does not appear to side with the parents on these issues. Multiple valid complaints have been dismissed.
TWO SOLUTIONS:
- Support amendments to TCA 49-6-2019 that make it enforceable.
- Elect a new Governor (thus a new commissioner of education) that will support and enforce this law.
